Terms & Conditions

Securing your order

1. Your initial payment is a retainer used to reserve your event date and is non-refundable. Orders under $100 must be paid in full when the order is placed. All other orders require a retainer of $100 or 50% (whichever is greater). Your date is not secure until this payment is received.

2. Invoices will be canceled at 5 p.m. on the due date if payment is not received.  There is a 5% fee incurred if the invoice is canceled and you request to have it resent.

   1. No previously added discounts will apply.

3. Your balance is due 2 weeks prior to your delivery/pickup date. If the balance is not received by the due date; you forfeit the date, the cost of the retainer, and your order will not be complete.

Design:    

1. Please review your invoice to verify the date, flavor, filling (if applicable), serving size, design, and all details. This is the final decision on the final look of your order.

2. Photos for inspiration are encouraged; however, Tee Tee’s Sweets LLC does not do exact replications.  Photos provided are for inspiration ONLY.

3. A sketch may be provided, upon request, after you have secured your date.

4. We will make every attempt to match your chosen colors. Please note that when dealing with food, there may be a slight color variance. Tee Tee’s Sweets LLC will not be responsible for color changes that may occur after the preparation of the food item.  

5. In choosing to have fresh flowers arranged on your cake, you acknowledge that fresh flowers are not food products and can be toxic or contain pesticide/herbicide, residues, dirt, insects, and/or other contaminants. Tee Tee's Sweets will clean all flowers; however, all responsibility for the freshness, color, overall condition, and cleanliness of the flowers rests with you.

6. The guest servings for the cake will be exact per the inquiry form. Tee Tee’s Sweets LLC is not responsible for any cake serving shortage.

7. On occasion, we will photograph our cakes and we reserve the right to use any photographs for display or promotion. This includes photos taken after the final setup at the venue.

8. I do not provide sketches or previews after your order is in progress. I strive to bring you the best possible product(s) as discussed in your consultation.  I will not copy another artist’s work but will use it as inspiration to give you your own unique item(s).

Changes

1. Changes to the number of servings, design, or flavors may be made up to 14 days before the delivery/pick-up date. You can only make changes to your order ONCE. Any changes requested may be subject to additional charges.

2. If your order is placed within 14 days of the due date, changes cannot be made without a 10% penalty.  There will be no refund of monies paid or credit for the request to "downsize" the order. If there is a request to increase the order, payment of the difference is due immediately or the request will not be honored.

3. While designing your order, if there are changes that need to be made, Tee Tee’s Sweets LLC has the absolute discretion to make the said changes and/or alterations to complete the order.

Delivery/Pickup

1. It is recommended that all custom cakes 2 tiers and greater be delivered to ensure safe arrival.   If you or your representative elect to pick up your order, you assume all liability for the condition of the order once it leaves our possession.  Driving and handling instructions will be provided in writing.  Repair of damages is subject to availability and will incur a service fee. 

2. In no event will we be liable to you for any indirect, direct, incidental, special, consequential, or punitive damage arising out of or relating to the order once it leaves the possession of Tee Tee’s Sweets LLC. Upon pickup or delivery of your cake, Tee Tee’s Sweets LLC is no longer responsible for any damages, care, or mishandling that may occur. You are responsible for providing an appropriate and secure table/surface; cakes are heavy and require a sturdy table and an optimal room temperature of 70° Fahrenheit or below.  Kindly do not place your cake outside for any outdoor event.

3. While we strive to deliver orders in a timely, professional manner, at times there may be incidents beyond our control that could delay delivery, including potholes, accidents, traffic delays, "Acts of God" or other natural disasters.  If such an event occurs, I will contact you immediately and waive the delivery fee if your order arrives more than 15 minutes late.

4. Pickups occur at a local, public meeting location.  Additional charges may apply if you are more than 10 minutes late. This fee must be paid before the order is relinquished.

Refunds

1. In no event shall we be required to refund any payment charged for any order. The sole remedies available to you in the event you cancel the order, or your event is postponed or rescheduled, are a credit on future invoices.

2. Because flavor and texture are subjective; refund requests based on the flavor and/or texture will not be honored.  

3. If you are unsatisfied with your order, we require that you return the uneaten portion of your order to us for evaluation within 24 hours. Any refunds given will be in the form of an order credit to be used within 60 days. 

 

Disclaimers

1. You understand that it is your responsibility to inform Tee Tee’s Sweets LLC, before booking the order, if there are any allergy concerns.

2. Our kitchen is NOT NUT-FREE! Our products may contain or come in contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guest of this risk and hold us harmless for allergic reactions.

3. MACARONS are made with ALMOND FLOUR.

4. You are also acknowledging and take responsibility for all NON-TOXIC items you chose for this order such as highlighter dust and disco dust.

Order Completion

1. The performance of this agreement is contingent upon our ability to complete the Agreement and is subject to accidents, Acts of God, and other causes beyond our control.

2. In no event shall Tee Tee’s Sweets LLC be liable for any failure or delay in the performance of her obligations hereunder arising out of or caused by, directly or indirectly, forces beyond her control, including, without limitation, strikes, acts of war or terrorism, civil or military disturbances, natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer services; it being understood that Tee Tee’s Sweets LLC shall use reasonable efforts which are consistent with accepted practices in the industry to resume performance of services as soon as practicable under the circumstances. 

3. In the event of a "natural disaster", emergency, or "Act of God", including a global epidemic, pandemic, endemic, or outbreak requiring the customer to request a change of event date; accommodations will be allowed based on availability.  Refunds will be decided on a case-by-case basis.  Retainers and the cost of supplies are non-refundable, and the items are retained by Tee Tee’s Sweets LLC.  

4. In the event of a nation-wide or "state of emergency," that causes events to be canceled or postponed by you or the event coordinator, retainer and supply cost refunds are not allowed; however, we will allow rescheduling of the date within 6 months of the event date and based on our calendar availability. 

   1. COVID-19: In the circumstance your event is canceled, postponed, or rescheduled under a COVID-19 related directive issued by any government entity, we will honor your payment made as a cake credit up to 6 (six) months. You are free to use this credit for any upcoming event; however, the date will be subject to Tee Tee’s Sweets LLC’s calendar.

5. In the event of the death of the customer/client, all monies will be refunded minus the retainer fee within 5-10 business days.  

6. You acknowledge that Tee Tee’s Sweets LLC has the right to cancel the order in the event she becomes ill or has a family emergency. The Client will be contacted and informed of the same as soon as humanly possible. In addition to that, the Client will receive a refund ONLY in such a circumstance.

7. In case of the death of Tee Tee’s Sweets LLC owner, all monies will be refunded within 60 days of her death by the authorized representative.  

8. For this contract, to “postpone” shall mean “to put off” an event, or an appointment while to “reschedule” shall mean to “schedule again” with a new time and date set.

We may amend the Terms at any time. The revised version will be effective at the time we post it. If we change the Terms in a way that reduces your rights or increases your responsibilities, we will provide you with a notification.

These Terms, together with any other materials referenced in or expressly made a part of these Terms, constitutes the final and entire Agreement between you and us.
